TERMS AND CONDITIONS OF WARRANTY

§1

1.

Prima Home gives the Customer a guarantee of quality of window and door frames produced in compliance with PN-88/B-10085 standard - "Building woodwork. Windows and doors. Requirements and testing" and technical approval AT-15-2949/00. This warranty is a proof of the guarantee granted.

2.

The quality guarantee covers product defects resulting from defective craftsmanship or use of defective materials (intrinsic defects relating to the item sold).

3.

Prima Home grants a 10-year warranty for the window frames  if they have been installed by an Authorized Sales and Installation Outlet, reckoned from the confirmed date of installation.

4.

The period of warranty for windows and doors purchased from Prima Home without installation is 1 year from the date of purchase. Defects in windows and doors resulting from defective installation by the customer are not subject to complaints.

§2

1.

The warranty covers products that:
- prior to installation were stored as required by PN-B-05000, i.e. in under a roof, in dry and well-ventilated rooms, on hardened floor, and on ground beams;
- have been installed in compliance with the "Window and door frames installation manual" appended to this warranty;
- have been maintained in compliance with the "Maintenance manual" appended to this warranty.

2.

For a detailed list of products (windows and balcony doors) covered by the warranty, see the sales receipt (invoice).

§3

1.

The Manufacturer undertakes to repair the defective products free of charge within the term of warranty.

2.

The method of repair is determined by the service engineer.

3.

Should the Manufacturer find that it is impossible to remove any defects from the product, the customer is entitled to a reduction in price or replacement of the defective products with new ones? In case of replacement, the customer is required to return the defective products.

§4

1.

Any possible defects covered by the warranty must be reported in writing to the place where the windows and doors were purchased.

2.

The vendor is required to complete the "complaint request" form and immediately send it to the entity authorized to handle complaints by the manufacturer.

3.

The condition for execution of the warranty rights, i.e. acceptance of the complaint and provide possible warranty service maintenance, is presenting the warranty along with the sales receipt (invoice).

4.

The manufacturer's representative or a person authorized by the same will evaluate the grounds for the complaint and determine the type of defects within:
- 21 days from the date when the complaint was received, with reference to natural persons;
- 42 days from the date when the complaint was received, with reference to other persons authorized by virtue of the warranty.

5.

The time appointed for removal of defects is 30 days from the date when the complaint was considered, excluding the time necessary for procurement of imported materials (hardware, paint).

6.

In agreement with the customer, the time referred to in 5 may be changed for important objective reasons (such as bad weather).

§5

1.

The manufacturer is not liable for defective or damaged products if the defect or damage is not due to intrinsic defects.

2.

The warranty does not cover:
- mechanical damage occurring after acceptance of the frames 
- damage resulting from misuse of the products, against the conditions given in the "Windows and doors use manual"
- damage resulting from exposure to coarse-grained cleaning agents, adhesive tapes, substances containing chlorine, acids or solvents,
- differences in paint color shades related to the window frame material,
- mechanical damage of glass panels,
- damage resulting from misfortunes beyond the Manufacturer's control: effects of weather (hailstorm, flood), caustic chemicals, etc.,
- damage resulting from excessive relative humidity of air (more than 90%),
- effects of failure to maintain the hardware,
- effects of failure to periodically adjust hardware, required when the windows are in use,
- effects of failure to maintain the varnish coat.

§6

1.

The user is deprived of rights under the warranty if:
- he reworks the product on his own (planes the frames and reveals, replaces hardware);
- the date of purchase, signature and stamp of the vendor are missing from the warranty;
- he makes changes to the warranty on his own;
- it is found that any kind of grating and protection have been fastened directly onto the frames, unless they are safe for the structure of the window;
- the gaskets or hardware are covered with paint;
- it is found that the frames have been installed prior to the so-called wet works in the building (plastering, flooring) that cause expansion of wood and deterioration of frames.

2.

Any defects resulting from misuse of the product, mishandling, incorrect maintenance and improper storage of the product and from other reasons beyond the manufacturer's control, may be removed only at the cost and expense of the user.

3.

Should an unjustified complaint be made, all related costs are charged to the customer.

4.

The competent court of jurisdiction for settlement of disputes that may arise out of this warranty is the manufacturer's court of venue.

§7

1.

In matters not regulated by this warranty, relevant provisions of the Civil Code are applicable.

2.

The competent court of jurisdiction for settlement of disputes that may arise out of this warranty is the manufacturer's court of venue.

3. The down payment is not refundable.

4. Merchandise if not paid in full, there is no Warranty.
